Imagineer has just released word that they were able to win the second trial when it came to infringement of the Medabots international name. The lawsuit was in the Spanish Commercial Courts of Alicante and the company won.

Imagineer Wopn Second Trial Regarding Medabots Trademark Use Against Kevin Comadrán de Frutos

According to the story by Silicon Era, the lawsuit was regarding Medabots international name in European territory. The issue was with regard to trademark infringement with Imagineer winning the second trial.

As per the Courts, it was recognized that the use of the name "Medabots" infringed the intellectual property rights of Imagineer. The name was reportedly used by Kevin Comadrán de Frutos, which per the Courts, infringed IP rights.

It was also revealed that the last decision by the court hasn't yet been final with an appeal that could potentially be filed. It was revealed that the case revolved around a lawsuit that was filed way back on May 26, 2020, by Kevin Comadrán de Frutos.

Medabots was Registered for an NFT Game Project by Kevin Comadrán de Frutos

This came as Kevin Comadrán de Frutos, who had not been associated with Imagineer at all, had registered the name Medabots in February 2018. The registration of the name was in order for him to launch his own NFT game project.

Imagineer announced that the company was able to win the second trial against Kevin Comadrán de Frutos. Imagineer was sued by Comadrán at the Commercial Court of Alicante in Spain regarding how the company infringed his trademark rights.

Comadrán Wanted to Stop Imagineer from Distributing and Marketing Games Under the Medabots Trademark

He reportedly intended to stop Imagineer from being able to distribute and market games under the name Medabots in Europe. Initially, Comadrán won the initial ruling by the EU Trademark Court on July 15, 2020.

However, the very same Court later dismissed the claim by Comadrán on November 29, 2021. This was as the court ordered a cancelation of what was said to be the EU trademark regarding the Medabots name.

Comadrán Appeals the Court Decision Hoping to Get Imagineer to Stop

On February 23, 2022, Imagineer reportedly received an appeal from Comadrán which was against the decision by the Court. Despite efforts, the appeal against the decision was reportedly dismissed later on September 15, 2023.

Imagineer is also expected to issue an official press release once the Court reaches a final decision regarding the case. The company also said that even if the case is appealed, they would still push on and continue to take action directly toward Comadrán's lawsuit.

Imagineer Plans to Go After Comadrán for the Bad Faith Use of the Medabots Name

They said that they would be pursuing legal action against Comadrán regarding the bad faith use of the name Medabots especially in the European territory. As highlighted in Asia IP Law, Imagineer remains the owner of the Medabots trademark.

Despite briefly losing its trademark in Europe, Imagineer was able to get it back but plans to pursue further action.
