A Tesla Model S car is displayed at a Tesla showroom on November 5, 2013 in Palo Alto, California. Tesla will report third quarter earnings today after the closing bell.

The billionaire claimed that if the Full Self-Driving feature can't be perfected, then Tesla will be entirely useless.

This means that the automaker's overall value depends on FSD. However, since this autonomous feature still has flaws, many experts criticized it.

Being imperfect is not the actual issue, but the remarks made by Tesla.

Now, California's regulators warned that the automaker might face penalties since its FSD advertisements are allegedly misleading.

Tesla FSD Accused of Being Deceptive!

According to Business Insider's latest report, the California Department of Motor Vehicles claimed that the marketing practices of Tesla for its Full Self-Driving tech are deceptive.

Tesla CEO Elon Musk uses his mobile device as he sits in the car arriving to the construction site for the new plant, the so-called "Giga Factory", of US electric carmaker Tesla in Gruenheide near Berlin, northeastern Germany.

In the complaint filed by DMV against the giant EV maker, the actual statements of the FSD advertisements were provided. These include the following:

  • "From home - All you need to do is get in and tell your car where to go."
  • "The system is designed to be able to conduct short and long-distance trips with no action required by the person in the driver's seat.

Based on these statements, Tesla claims that the FSD can really drive the EV on its own. However, the autonomous feature is still far from doing that.

Because FSD still can't operate without the driver paying attention on the road, California officials warned that these ads violate the law.

Their complaints added that the automaker's advertisements use untrue claims to promote autonomous tech.

Now, if the carmaker is proven to be misleading consumers, it can face penalties, such as suspension or revocation of its license to sell electric cars.

On the other hand, California DMV can also order Tesla to pay the customers that were deceived by the FSD marketing practices.

Tesla Needs to Respons ASAP

Anita Gore, California DMV's Deputy Director for the Office of Public Affairs, said that Tesla needs to respond to the complaints within 15 days.

Since the filings were released on July 28, the automaker has until Aug. 11 or Aug. 12 to provide its statements regarding the FSD deception accusations.

If the EV maker fails to comply, Gore said that DMV would take a default decision.

Recently, Tesla Europe started selling its Model S and Model X after the 2021 production shutdown.

On the other hand, Elon Musk announced that three million Tesla EV units had been produced ever since the company was founded back in 2004.
